Detailed Description of Goods and/or Services
Nyama Catering CC is an online store in the food industry.
Agreement of Sale
An agreement of sale between Nyama Catering CC and a customer is only valid once payment has been made and the company receives proof of payment. Up until this point all goods remain the property of Nyama Catering CC.
Delivery Policy
Subject to availability and receipt of payment, orders will be processed within three days. We dispatch orders via courier service. A delivery being delayed is not grounds for return or refund.
You accept that in order for us to prove delivery of an order, we do not have to prove that you personally received the goods, but rather that any person at the delivery address signed for the delivery.
Return and Refunds Policy for Braai Sauces and Spices
The provision of goods and services by Nyama Catering CC is subject to availability. In cases of unavailability, Nyama Catering CC will contact you with options.
If a product is damaged or broken when you receive it, you must inform Nyama Catering CC within 24 hours of receiving it. We will then make arrangements for a replacement product to be sent to you on our account or to refund you in full for the damaged or broken product.
If you are not completely happy with a product that you received with your order, you can contact us within 24 hours of receipt with the reason of dissatisfaction. If the product is in its original sealed state we will issue a return number and a return delivery address. Shipping costs for the return will be for your account. Upon receipt, we will inspect the item and if it is in its original sealed state, we will refund you the value of the product. If you have opened and/or used the product and are not satisfied, Nyama Catering CC will not be held responsible for issuing a refund.
If you receive the wrong product you must contact Nyama Catering CC within 24 hours. We will check our system to see whether a miss pick has occurred. If there was a miss pick we will arrange to swap the ‘wrong’ product for the one actually ordered on our account.
Exchange and Refund Policy for Flip Grid Braaiers and Spit Braais
This Exchange and Refund Policy regulates the extent to which you may cancel your purchases made on the website and be refunded before or after receiving the product, as well as what your remedies are if the product you received is defective. It also explains the process you must follow to cancel a purchase properly, report a defect, and arrange for a return. You are not entitled to any refund, repair or replacement save to the extent that it is expressly provided for under this Exchange and Refund Policy or if the seller of the product (be it Nyama or a Marketplace Seller), in its sole discretion and without being obliged to it, chooses to give you a refund, repair or replacement.
YOUR RIGHTS TO CANCEL, RETURN AND/OR BE REFUNDED
Early Cancellations:
You are entitled to cancel any purchase without attracting any cancellation and/or administration charge if you cancel before production starts on the product. If timeously cancelled as aforesaid, you will be fully refunded in respect of such cancelled purchase (including delivery charges) without any administrative or other charge being payable. For cancellation after production has started, a 50% refund applies.
Stock Shortages:
Should a product that you’ve ordered be out of stock, the seller thereof will notify you, after which:
- In the event of a temporary out-of-stock situation, you shall be entitled either to cancel the order and be fully refunded or to maintain the sale subject to a later delivery date as may be agreed;
- In the event of a permanent out-of-stock situation, you shall be entitled to be fully refunded.
In being ‘fully refunded’ as aforesaid, you will be refunded the relevant purchase price and delivery charges without paying any administrative or other charges.
Incorrect Product Delivered:
If the incorrect product is delivered to you (i.e., it is not the product you purchased), please do not remove the product from its original packaging or open or use the product in any way. Please promptly contact the seller so that the seller can resolve the mistake by arranging to collect such a product from you and deliver the correct product as quickly as possible.
Defective Products:
General Rule: If, within seven days after delivery of a product:
- You find that the product is defective/faulty
- You can return such product to the seller in good condition
- Suppose the product is subsequently found to be indeed Defective. In that case, you are entitled to either (a) have the product repaired or replaced at the seller’s expense or (b) be fully refunded.
- If the product is subsequently found – NOT to be Defective, you will not be entitled to any refund or free replacement or repair. You may be liable for the costs incurred in having such a product collected from and returned to you.
When is the product ‘defective’?
Please note that the following issues/problems will not render the product damaged, defective or unsuitable as aforesaid and will not entitle you to any repair, replacement or refund:
- Faults resulting from normal wear and tear;
- An instance where you or someone unauthorised to do so by the seller has altered, repaired or damaged the product (via misuse or abuse)
Important: You should refuse to accept delivery of any product that is visibly damaged, and if you only discover the damage after the courier has left (e.g., a cracked glass panel), then you must report it to the seller as soon as possible and within 48 hours. If only reported after 48 hours, it is reasonable for the seller to determine that the damage was caused post-delivery.
RETURN AND REFUND PROCESS
Returns:
Suppose you wish to return any item(s) you have purchased. In that case, you can return the item(s) via courier or in person to our warehouse (only) within seven days from the date of purchase.
We encourage you to return your parcel in person, as all returned packages remain the responsibility of the purchaser until received by Nyama.
Suppose you want to return a product you have purchased from Nyama for any reason permitted under this Exchange and Refund Policy. In that case, in all instances, you must first notify Nyama to inform us of the reason for your return by contacting us at 0123472795, 0833507306 or [email protected].
Refunds:
Your bank details will be requested via email to proceed with the refund once Nyama has conducted its investigation and found that a refund has been validated.
Please note that cash refunds will not be provided under any circumstances.
Free Delivery
Free delivery discount code: Applies to courier delivery method only. The code must be applied at checkout to qualify. It cannot be used in conjunction with other discount codes. One user per customer.
Customer Privacy Policy
Nyama Catering CC shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
Nyama Catering CC respect your privacy. This means that any of the personal information collected on this site will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned. Any information you provide will be held with the utmost care and will only be used to process your order and to provide you with the best possible service. Payment Options Accepted
Payment may be made via Visa, MasterCard, and American Express credit cards or by bank transfer or cash deposit into the Nyama Catering CC bank account, the details of which will be provided during the checkout process.
Credit Card Acquiring and Security
Credit card transactions will be acquired for Nyama Catering CC via Virtual Card Services who use the strictest forms of encryption.
Customer Details Separate from Card Details
Customer details will be stored by Nyama Catering CC separately from card details which are entered by the customer on the Virtual Card Services secure payment terminal.
Merchant outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is South African Rand (ZAR).
Responsibility
Nyama Catering CC takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Disclaimer
It is our mission that all information on this website is as accurate and up to date as possible, and that all products promoted cause no harm to our customers or the environment. However, due to the possibility of human and technical error, Nyama Catering CC accepts no responsibility for the accuracy or completeness of information provided on the website. Neither do we accept responsibility for any adverse reactions that any of our products may cause. We have taken every reasonable measure to ensure that the products promoted on this website are of the highest quality and safety.
Use of the Website
This site may be used by customers to browse the content and products and to make legitimate purchases. Persons may not use this site for any purposes such as fraudulent or speculative transactions or to copy, reproduce, republish or redistribute any of the images or content available on the site.
